Compulsory purchase powers are provided to enable acquiring
authorities to compulsory purchase land to carry out a function
which Parliament has decided is in the public interest. Anyone who
has land acquired in this way is generally entitled to compensation
in accordance with defined procedures.
Whilst other bodies do have compulsory purchase powers those
situations where it might potentially arise in the City would be by
the Local Authority, the major utilities, or as a result of an
Order under the Transport and works Act 1992.
Compulsory purchase powers are to be used sparingly and purchase
by agreement should always be pursued first.
Where compulsory purchases is being pursued there are procedures
in place which involve an objection and appeal process.
Compensation is payable in accordance with defined procedures.
The City Corporation as Local Authority would not use compulsory
purchase orders except where necessary to fulfil a major public
interest.
