Building over a highway

Licences to construct a building over any part of a highway maintainable at the public expense (section 177(1) of the Highways Act 1980)

Buildings over privately maintainable highways do not need to be licensed and no applications for licences to construct buildings over privately maintainable highways will be accepted.

The City of London Corporation cannot grant a licences to construct a building over a highway for which Transport for London is the highway authority. Persons wishing to construct a building over such a  highway should contact Transport for London about obtaining a licence.

A licence applications to construct a building over a highway should include:

  • The full address of the proposed building and the name(s) of the highway(s) over which the building is to project.
  • The name and full contact details of the licence applicant.
  • The name and full contact details of any agent(s) for the licence applicant.
  • Full details of the proposed building projection including two sets of drawings to appropriate scales including (i) a site plan showing the proposed building projection and the highway(s) over which the proposed building projection is to project; and (ii) detailed plans, sections and elevations as appropriate showing the highway boundaries, the kerb line(s) (if any) and full details of the proposed building projection.
  • Reference details of the technical approval of the proposed building projection including the date of issue of the design and check certificate(s).
  • Reference details of the planning permission for the proposed building including the application reference number and the date of the permission.

Where technical approval is required the licence to construct the proposed building projection will not be granted unless and until the design and check certificate(s) have been issued.

Where planning permission is required the licence to construct the proposed building projection will not be granted unless and until planning permission has been granted.

The fee for each licence to construct the proposed building projection is £5,000 for major (habitable) projections and £1,500 for minor (architectural) projections. Where the proposed building involves both minor and major projections the fee is £5,000. No application for licences will be accepted without payment of the appropriate fee.
