Carrying out works to admit air or light

Consent to the carrying out of any works in a street to provide means for the admission of air or light to premises situated under, or abutting on, the street (section 180(2) of the Highways Act 1980)

The City of London Corporation is empowered to consent to the carrying out of any works in any street in the City of London to provide means for the admission of air or light to premises situated under, or abutting on, the street regardless of whether the City Corporation or Transport for London is the highway authority for that street.

Applications for consent to make an opening in the footway of a street as an entrance to a cellar or vault thereunder should include:

  • The full address of the building or site and the name(s) of the street(s) in which the footway(s) in which the proposed opening is to be made is or are situated.
  • The name and full contact details of the applicant for consent.
  • The name and full contact details of any agent(s) for the applicant for consent.
  • Full details of the proposed opening in the footway including two sets of drawings to appropriate scales including (i) a site plan showing the proposed opening in the footway and the street(s) in which the footway(s) in which the proposed opening is to be made is or are situated; and (ii) detailed plans, sections and elevations as appropriate showing the street boundaries, the kerb line(s) (if any) and full details of the proposed opening in the footway.
  • Reference details of the technical approval of the proposed opening in the footway including the date of issue of the design and check certificate(s).
  • Reference details of the planning permission for the proposed opening in the footway including the application reference number and the date of the permission.

Where technical approval is required the consent to make the proposed opening in the footway will not be granted unless and until the design and check certificate(s) have been issued.

Where planning permission is required the consent to make the proposed opening in the footway will not be granted unless and until planning permission has been granted.

The fee for each consent to the carrying out of any works in a street to provide means for the admission of air or light to premises situated under, or abutting on, the street is £3,000. No application will be accepted without the fee.
